  1. Introduction

The right to privacy and the right to personal data protection specifically, is one of the values of FLUIDRA S.A (hereinafter, FLUIDRA), which is included in our Code of Ethics.

The purpose of this policy is to explain how FLUIDRA will process the personal data that may be collected through the different forms on FLUIDRA’s Website. Your personal data will be processed confidentially and only for the purposes you have consented to, as explained below in this General Privacy Policy and in each of the Privacy Policies on each form.

 

  1. Commitment to privacy

FLUIDRA is fully committed to complying with the law and the European Union’s General Data Protection Regulation and the regulations regarding the protection of personal data in force at any time, being a priority goal for FLUIDRA.

Therefore, FLUIDRA has decided to implement the following principles, privacy being the basis on which all processing is configured:

  • Transparency in data processing is one of our priorities, so whenever we ask you for personal data, we’ll inform you accordingly of the purposes of said processing in the corresponding privacy policy.
  • We will always process the data that is strictly necessary to carry out the informed processing.
  • We will never force you to provide personal data, unless they are really necessary to provide the service you request.
  • Whenever possible, we will put simple means at your disposal so you can control your personal data.
  • We won’t share data with any third party, except for our providers, or with those who we have previously informed you about and for which we have your consent.

Purposes of the processing.

FLUIDRA collects your personal data in order to manage your requests and offer you the services and products you may be interested in. Specifically, we process your personal data with the following purposes:

  1. To be able to answer the queries, questions or requests you send through the service, communication or press channels on each web page and to get in touch with you to solve them.
  2. To improve our web pages, services, products, and offer a better service and content.
  3. To offer you access to the restricted areas of our website (the registration process may require acceptance of a specific privacy policy).
  4. To provide you information if you are a distributor
  5. To be able to inform you about the vacancies in our Group through our Careers Site.

In some cases, we may need to process your personal data to comply with legal obligations or in relation to any contractual relationship we may have with you.

Within the framework of its promotional activity, FLUIDRA can provide registration or subscription resources to the company’s newsletter, as well as its general and commercial information. These resources will always be subject to your consent to send them.

If you authorise us, FLUIDRA will send you information about its products, activities and personalised services according to your tastes and preferences.

You may revoke your consent to receive commercial communications at any time, through the link or control to that effect in each of the communications, or communicating your desire to revoke your consent through the following channels:

  1. Automated decisions and profiling

For some services, we may process your personal data using automated means. This means that certain decisions are made automatically without human intervention. For example, if you have selected products, we may automatically send you communications informing you that the product is still available.

Other processing we can carry out is developing a profile in order to predict your behaviour on our website, showing you products that may be of interest on the main page, based on the preferences you have shown through your browsing or information obtained through cookies.   1. Processing duration and conservation period

At FLUIDRA, we are committed to processing personal data as long as they are really useful to us and we can offer you a quality service through their use. Therefore, we will make all reasonable and timely efforts to minimise personal data processing and their conservation period.

In this sense, we will inform you of the expected processing and/or conservation period of your personal data in each data collection form.

In any case, and even if you ask us to delete your data, we may keep them, appropriately blocked, for the necessary time to comply with our legal obligations and to provide them to the competent Authorities in the different applicable areas.

 

  1. Exercise of rights and claims before the Spanish Data Protection Agency

As a result of FLUIDRA’s processing of your personal data, the current legislation grants you a number of rights. Below, we offer a summary explanation of each right, to help you exercise them:

  • Right of access: You will have the right to know which of your personal data we process and the purpose for which we process them.
  • Right of rectification: Your data will always be yours and as such, you can ask us to rectify them at any time if the data that appear in our records are wrong.
  • Right of deletion: You may request that your personal data be deleted from our files at any time. However, and as we stated in the section on data conservation above, keep in mind that, under certain circumstances, compliance with current legislation may prevent the effective exercise of this right.
  • Right of opposition: you may object to the processing of your data in relation to any of the purposes for which we process them, in accordance with the privacy policies applicable in each case.
  • Right of processing limitation: you may request processing limitation in the following cases:
  1. If you consider the data we have belonging to you are not correct or exact;
  2. If you consider we aren’t processing your data legitimately, but you prefer we limit their processing rather than delete them;
  3. If we no longer need the data we have according to the purpose for which we collected them, but you need to keep them to file legal claims;
  4. If, having exercised the right to oppose any processing, you are awaiting a response on our part.
  • Right to the portability of your data: You will have the right to, whenever it is technically possible and reasonable, request that the personal data you have provided us directly be communicated to another data controller. If it is possible, we will provide your data directly to said other data controller, but if it is not, we will provide them to you in a standard format.

Whenever we process your data based on consent, you can revoke it at any time, without having consequences for you beyond, depending to the exercised right, us not being able to provide certain services.

If you don’t want to exercise a specific right, but you have a question or suggestion in relation to the processing of your personal data, you can also get in touch through the addresses provided for the exercise of rights.

Please note that you can always, in any case, file a claim with the Competent Authority regarding data protection if you believe that we have not treated your data in a lawful manner or that we have not answered to your requests or rights. In Spain, said Competent Authority is the Spanish Agency for Data Protection.

 

  1. Confidentiality and Security in data processing

Your personal data are very important to us and we are committed to processing them with the utmost confidentiality and discretion, as well as to implementing all security measures that we consider appropriate and reasonable.

In this sense, FLUIDRA declares and guarantees that it has established all the technical means at its disposal to avoid the loss, misuse, alteration, unauthorised access and theft of the data provided by users.

Social Media are part of the daily lives of many Internet users, so we have created several FLUIDRA accounts.

All users have the chance of joining FLUIDRA’s pages or groups on Social Media.

However, you must take into account that, unless we request your information directly (for example, through marketing activities, contests, promotions or any other valid form), your data will belong to the Social Media channel you’re using, so we recommend that you read their terms and conditions of use and privacy policies carefully, as well as make sure to configure your preferences regarding data processing.
